CATAWBA TRIBE SUES FOR GAMING RIGHTS ON RESERVATION LAND

From Chief William Harris and CIN Executive Committee

"Study Shows Gaming Facility Would Create 3,966 New Jobs in York County"

The Catawba Indian Nation has filed a lawsuit against South Carolina seeking to enforce compliance with the Settlement Agreement the Tribe signed with the State of South Carolina in 1993.

William Harris, newly elected Chief of the Catawba Nation, says the purpose of the lawsuit is to assert the legal rights of the Catawba Tribe and, at the same time, to bring significant economic benefit to the Tribe and the York county area, including nearly 4,000 permanent new jobs. "The economic development we seek for the Tribe would also be a major boost to the local economy," Chief Harris said.

Confident that the Catawba Nation is entitled to open a gaming facility on reservation land, the Tribe recently commissioned an economic impact study by the Columbia, S.C.-based firm of Miley & Associates. That study reported the proposed gaming facility would generate over $517 million in total initial economic impacts and 3,966 permanent jobs, including a projected hotel and entertainment complex. If the Catawba Tribe is successful in asserting its gaming rights, Chief Harris stressed that all gaming would be restricted to reservation property where the Catawba Tribe was promised gaming rights by federal and state law nearly 20 years ago.

The lawsuit asserts that the State of South Carolina is obligated to honor the promises contained in the Settlement Agreement and the failure to do so has deprived the Tribe of its legitimate claims. The Settlement came only after many years of struggle. According to the Settlement Agreement, signed during the administration of Governor Carroll Campbell, the Tribe was promised the ability to offer "…electronic play devices to the same extent that the devices are authorized by state law.” More recently, South Carolina passed the Gambling Cruise Act, which authorizes by state law the operation of numerous electronic gaming devices. Under the terms of the Settlement, the Tribe believes that it should be able to offer those same games.

"The Tribe’s ability to engage in gaming activities is vital to its economic self-sufficiency," Chief Harris said. "All we want is for the government to keep its promises and allow us to conduct gaming on our Reservation land.” As is the case with many Native American tribes who were removed from their land and suffered decades of subjugation, the Catawba Indian Nation struggles with poverty and related issues. The type of facility the Catawba Tribe hopes to operate would create permanent positive impacts on the York/Lancaster area, the Catawba Indian Nation and their people.

Finally, if left up to Catawba, the fiscal impacts of the Catawba Gaming Facility operations would have a substantial positive impact on State government revenues, as the Tribe is committed to being a good citizen of its South Carolina community. The Miley Economic Impact Study may be viewed in its entirety at mileyandassociates.com/reports/.

The Tribe is supported in its efforts by Sky Boat, LLC, and it is working with a team of local and national attorneys. According to Chief Harris, “With the law and justice on our side and such capable supporters and advocates, the Tribe is confident our rights will be vindicated.”

Mobile phones. Orange or LG Electronics: who fails?

On August 2010 I bought from Orange Romania SA a mobile phone, LG GT405. First video that I made was with deficiency, but I didn't use the warranty to repair it.

After one year, the touch screen is blocked, so I went to the store from where I bought it asking to be repaired.  I mentioned both the problems with the touch screen and the video. The warranty is for 2 years.

I received back the mobile phone, with the mention that the touch screen was replaced. No mention about video. The quality of the videos remained the same. I sent it back asking to take a look at the video.

This time I have received back the mobile phone with the mention that the video camera was replaced. I tried it, and there was no change in the quality of the films. I sent it back.

This last time, I have received it back with the mention: "unconfirmed deficiency". I made a last video with the mobile phone after I have received it, this one that I uploaded to YouTube at http://www.youtube.com/watch?v=t-hLg2IysM0. The original file can be downloaded from http://www.sfetcu.com/MOV010.3gp.

As you can see the video, please help me to understand writing your opinion, if:

 1. I am wrong, the image has a good/standard quality, and Orange has right with the mention that the deficiency is unconfirmed;

 2. The image is with deficiency but this is the normal quality of the LG mobile phone videos, so it is not Orange's fault;

 3. The image is with deficiency and LG Electronics manufactures mobile phones with a better quality of the videos, but Orange didn't respect my rights;

 4. Other situation (please name it).

P.S. I notified both Orange and LG Electromics about this problem. Orange sent me an answer in which I am adviced to send them a request (I sent it three times!). I have no answer from LG Electronics yet.

Fitzgeralds closes poker room

The Sign at (what was) the Fitzgerald Poker Room

In what we hope does not start a trend, the poker room at Fitzgeralds downtown has quietly closed.

Other poker rooms, such as Silverton, have limited their hours.

Fitz had a tough time since launching their poker room upstairs a few years ago.  Only attracting 1 or 2 tables worth of players, they tried tournaments, sit-n-gos, freerolls, high hand jackpots, but in the end it didn't justify the cost and was shuttered.

Poker jargon - S

satellite
A tournament in which the prize is a free entrance to another (larger) tournament.
scare card
A card that comes that may have improved an opponent's hand. The Jack of spades on the turn was a scare card because it put both flush and straight possibilities on the board.
scoop
In high-low split games, to win both the high and the low half of the pot.
set
Three of a kind, esp. the situation where two of the cards are concealed in the player's hole cards.
set-up
A deck that has been ordered, usually King to Ace by suit (spades, hearts, clubs and diamonds). In casinos, it is customary to use a set-up deck when introducing a new deck to the table. The set-up is spread face up for the players to demonstrate that all of the cards are present before the first shuffle. Also called to "spade the deck".
shootout
A poker tournament format where the last remaining player of a table goes on to play the remaining players of other tables. Each table plays independently of the others; that is, there is no balancing as players are eliminated. This format is particularly common in European televised poker programs, including Late Night Poker.
side pot
A separate pot created to deal with the situation of one player going "all in".
16-way straight draw
A hand in draw poker such as 6♥ 7♥ 8♠ (Joker), in which any of sixteen cards (4 fours, 4 fives, 4 nines, 4 tens) can fill a straight.
slow roll
To delay or avoid showing one's hand at showdown, forcing other players to expose their hands first. When done while holding a good hand likely to be the winner, it is considered poor etiquette, because it often gives other players "false hope" that their hands might win before the slow-roller's is exposed.
small blind special
A situation in which (assuming no raising) a player is dealt weak hole cards in the small blind, but ends up making the best hand because they got to see a relatively inexpensive flop.
speeding
To play very loose with no identifiable pattern, or to bluff frequently. Also known as speeding around.
spike
When a flop is spread out, if the first card revealed is the card an underdog needs, they spike that card. More loosely, if any of the flop cards help you, then you spike it. I had Q9 to my opponent's pocket jacks, but I spiked a queen on the flop to take the lead.
splash the pot
To throw one's chips in the pot in a disorderly fashion. Not typically allowed, because the dealer can't tell how much has been bet.
spread
The range between a table's minimum and maximum bets.
stack
A collection of 20 poker chips of the same denomination, usually arranged in an orderly column.
stakes
The definition of the amount one buys in for and can bet. For example, a "low stakes" game might be a $10 buy-in with a $1 maximum raise.
stand pat
In draw poker, playing the original hand using no draws, either as a bluff or in the belief it is the best hand.
steam
Act of playing recklessly when one is frustrated.
stop 'n go
When a player bets into another player who has previously raised or otherwise shown aggression. Example: On the flop, Bill bets into Tom, Tom raises, and Bill just calls. On the turn, Bill bets into Tom again. Bill has just pulled a stop 'n go.
straight
  1. Poker hand
  2. When used with an amount, indicates that the speaker is referring to the total bet, versus the amount being raised. Alice bets twenty. Bob raises to fifty straight.
strategy card
A wallet sized card that is commonly used to help with poker strategies in online and casino games.
string bet
To call with one motion and raise with another, or to reach for more chips in the middle of laying a bet/raise without stating the intended amount. String bets are prohibited in public cardroom rules.
stuck
Having lost money. I'm stuck $300 right now.
stud
  1. A variant of poker.
  2. A card dealt face up in Stud poker.
suck out
To draw a winning hand despite poor odds.
sucker straight
In community card poker variants, a straight completed on the low end of the possible straight on the board.
suited
Having the same suit. See card suits.
super satellite
A multi-table poker tournament in which the prize is a free entrance to a satellite tournament or a tournament in which all the top finishers gain entrance to a larger tournament.
